FIRE Coalition Holds Constitution Week Press Conference with Lawmakers Sept. 19, 2007

The Federal Immigration Reform & Enforcement (FIRE) Coalition held a press conference on September 19, 2007 in support of the U.S. Constitution and House Concurrent Resolution 40 in cooperation with Congressman Virgil Goode, 5th District, Virginia, the resolution's sponsor. HCR-40 “Express[es] the sense of Congress that the United States should not engage in the construction of a North American Free Trade Agreement (NAFTA) Superhighway System or enter into a North American Union with Mexico and Canada, in support of the Constitution, including specifically Article 1, Section 8, Article IV, Section 4, and in support of the FIRE Coalition Project "Operation FIRE & ICE", which promotes the ICE 287(g) Delegation of Immigration Authority Program.

Feds and North Carolina Sheriffs Work Together to Capture Criminal Aliens

by Jim Kouri, CPP - US Immigration and Customs Enforcement (ICE) representatives today presented a proposed statewide partnership plan to the sheriffs in attendance at the North Carolina Sheriffs' Association's (NCSA) fall meeting. This is the first in many conversations between federal and local officers aimed at affording every area of North Carolina increased use of the unique authorities of ICE.

Many sheriffs' departments in North Carolina have shown significant interest in partnering with ICE primarily to help identify and remove criminal illegal aliens. To date nearly 20 agencies have requested a partnership with ICE under the 287(g) program -- which trains and certifies officers to enforce immigration law.

"North Carolina sheriff's offices have demonstrated an unprecedented interest in partnering with ICE," noted Julie L. Myers, Department of Homeland Security Assistant Secretary for ICE. "By working together in a coordinated manner, we plan to develop a statewide alliance that is both effective and sustainable and will enhance public safety in the state."

Driven by a steering committee comprised of local and federal officers, partnering agencies will develop appropriate timelines and agree on how to best leverage the tools ICE has available under the ICE ACCESS (Agreements of Cooperation in Communities to Enhance Safety and Security) program. Depending on the specific needs, North Carolina sheriffs' departments would participate in ICE ACCESS programs and services including: the Law Enforcement Support Center (LESC) which helps identify criminal aliens; ICE's Criminal Alien Program (CAP) which locates criminal aliens processed through jails and prisons; Operation Community Shield which targets and arrests gang members; joint document and benefit fraud task forces to impede identity theft; and the delegation of 287(g) authority.v

Mecklenburg, Alamance, Gaston and Cabarrus county sheriff's offices have already partnered with ICE by entering into 287(g) Memorandums of Agreement (MOAs).

ICE received more 287(g) requests from agencies in North Carolina than any other state.
Recognizing this intense interest, Senator Elizabeth Dole brought together the impacted state and federal agencies to discuss ways to best prioritize needs on a statewide basis.

"When it comes to tackling the complex issue of immigration, Washington is often accused of not listening. I want to commend ICE for not only listening, but also delivering for North Carolina. Through this unique partnership with federal officials, North Carolina sheriffs can utilize the available tools to enforce our laws and help ensure that North Carolinians feel safe in their homes and communities."

"We are pleased ICE has recognized the statewide interest to help remove criminal illegal aliens and we look forward to working with the agency to craft a feasible plan benefiting all of our communities," said North Carolina Sheriffs' Association President Sheriff Steve Bizzell.

SENATE BILL 229
RATIFIED BILL AUGUST 02, 2007
AN ACT TO DETERMINE THE RESIDENCY STATUS OF PERSONS JAILED ON
FELONY OR DRIVING WHILE IMPAIRED CHARGES.
The General Assembly of North Carolina enacts:

SECTION 1. Chapter 162 of the General Statutes is amended by adding a new section to read: "§ 162-62. Legal status of prisoners. (a) When any person charged with a felony or an impaired driving offense is confined for any period in a county jail, local confinement facility, district confinement facility, or satellite jail/work release unit, the administrator or other person in charge of the facility shall attempt to determine if the prisoner is a legal resident of the United States by an inquiry of the prisoner, or by examination of any relevant documents, or both.
(b) If the administrator or other person in charge of the facility is unable to determine if that prisoner is a legal resident or citizen of the United States or its territories, the administrator or other person in charge of the facility holding the prisoner, where possible, shall make a query through the Division of Criminal Information (DCI) system to the Law Enforcement Support Center (LESC) of Immigration and Customs Enforcement of the United States Department of Homeland Security. If the LESC determines that the prisoner has not been lawfully admitted to the United States, the United States Department of Homeland Security will have been notified of the prisoner's status and confinement at the facility by its receipt of the DCI query from the facility.
(c) Nothing in this section shall be construed to deny bond to a prisoner or to prevent a prisoner from being released from confinement when that prisoner is otherwise eligible for release.
(d) The administrator or other person in charge of the facility shall annually report the number of queries performed under subsection (b) of this section and the results of those queries to the Governor's Crime Commission of the Department of Crime Control and Public Safety. The Governor's Crime Commission shall make the reports available to the public."

SECTION 2. This act becomes effective January 1, 2008. In the General Assembly read three times and ratified this the 2nd day of August, 2007.


North Carolina, "First in Enforcement," is on FIRE and ICE!

North Carolina has a long history of being first. From the time of the American Revolution, the "Pitt Resolves," and "Halifax Resolves" to being "First in Flight," as evidenced by the state license plate to commemorate the Wright brothers historic flight at Kill Devil Hill on the outer banks of North Carolina to this state's growing status as "First in Enforcement," Tarheels have a long history of being among the first to stand up for what is right. The North Carolina Legislature's ratification of Senate Bill S-229 will essentially mandate 287(g) participation, even though it doesn't specifically require it. Why is this such a big deal? Well, come January 01, 2008 all North Carolina jails will have to check the legal status of anyone arrested for a DWI or felony offense. That means the thousands of criminal illegal aliens passing through the North Carolina justice system will no longer be wearing the king's new clothes, and North Carolina law enforcement officers will no longer have their hands tied when it comes to combating the massive criminal illegal alien problems plaguing North Carolina counties, cities, and towns.
Last fall Congressman Sue Myrick R-N.C. and ICE Director Julie Myers referred to Sheriff Jim Pendergraph's Mecklenburg County Jail's 287(g) participation a "model example" for others to follow. Other N.C. counties have since signed up and the North Carolina Sheriffs Association helped develop the legislation that was ratified on August 2, 2007 by an overwhelming majority. Hats off to the N.C. Legislature and the N.C. Sheriffs Association for showing the character and integrity to stand up and protect the citizens of North Carolina.
Operation FIRE & ICE Project Director Jeff Lewis is working closely with participating sheriff departments in North Carolina to develop educational and informational media for distribution across the nation to promote the 287(g) program. • Minimum two Years Experience in Current Position; and
• No Disciplinary Actions Pending.
Training Requirements

ICE offers two training programs including a five-week program for
field level law enforcement officers and a four-week program for correctional personnel. The U.S. Immigration and Customs Enforcement
Academy sets standards and testing and certified instructors conduct
the training.
